Version françaiseTerms of sale and subscription
1. Seller and scope
These terms apply to any sale of EnterTrainMe digital content and services to a consumer, through the website or the apps, by Jean Paul BELLA, Sole proprietor (micro-entrepreneur), SIRET 834 792 905 00038, 195 rue de la Montagne, 57200 Sarreguemines, France, [email protected] (the “Seller”). VAT not applicable, art. 293 B of the French Tax Code. They supplement the terms of use. Placing an order means you accept them.
2. Products and services
- Premium subscription (monthly or yearly): access to all Premium features (full access to trainings, advanced statistics and progression, AI coaching, early access to new features) and 3 free AI credits every month, which do not carry over from one month to the next.
- AI credits (single, or pack of 10): they let you generate artificial-intelligence analyses: training review, progression plan, JpecTrainer video analysis. One analysis uses 1 credit.
- Paid programmes and trainings in the catalogue: digital access to content, permanently for the buying account.
The main characteristics of each product are shown before you order. They are content and services supplied electronically, with no physical delivery.
3. Prices
Prices in euros, at the date these terms were last updated, for purchases on the website: Premium monthly €5.00 per month; Premium yearly €50.00 per year; 1 AI credit: €1.00; pack of 10 AI credits: €7.00. The price of each paid programme or training is shown on its page. VAT not applicable, art. 293 B of the French Tax Code: the price shown is the price to pay, with no VAT added.
In the apps, purchases go through the App Store or Google Play: the price shown by the store (in your currency, including local taxes where applicable) is the price that applies and may differ from the website's. The applicable price is always the one shown when you order; a price change does not affect orders already placed, except the renewal of a subscription (see below).
4. Ordering and payment
- On the website: secure card payment via Stripe, charged when you confirm the order. We never have access to your card number.
- In the apps: payment charged by Apple (Apple ID account) or Google (Google Play account) under their terms.
- The order is binding after payment is confirmed; you receive a confirmation (Stripe email, store receipt). If payment is declined, the order is not validated.
5. Supply and performance
Content and services are supplied immediately after payment is confirmed (Premium access activated, credits added to your account, content unlocked). A synchronisation incident may delay activation by a few minutes; write to us if it does not happen.
6. Subscription: term, renewal, cancellation
- The subscription is taken for one month or one year and is renewed automatically for the same term, at the price then in force, until cancelled.
- Cancellation: at any time, free of charge. It takes effect at the end of the period already paid; you keep Premium access until then. The price of the current period is not refunded, except under a right of withdrawal or a legal provision.
- Subscription bought on the website: cancel from your account on the website (“Tarifs” page, “Cancel” button in the box showing your active subscription) or by writing to us. Subscription bought through the App Store or Google Play: cancel in your Apple or Google Play account settings (see Account deletion for the paths) — we cannot do it for you. Deleting your account does not cancel a store subscription.
- Price changes: we notify you at least 30 days before the renewal concerned; you may cancel beforehand without bearing the increase. For store subscriptions, the store handles this notice and your consent.
- Failed payment: if a renewal fails, Premium access may be suspended until it is settled.
- Subscriptions do not stack: you cannot take a second Premium subscription while one is active.
7. AI credits
- Order of use: the month's free credits (Premium subscribers) are used first, then purchased credits.
- Duration: purchased credits do not expire as long as your account exists. Free credits given to subscribers are valid within the month and do not carry over; they end with the subscription. A free trial of video analysis is offered to non-subscribers.
- Nature: credits are attached to your account, personal, non-transferable and with no cash value; they cannot be exchanged or refunded in money, except under a right of withdrawal or a legal provision.
- Technical failure: if an analysis fails for a technical reason (for example the AI provider is unavailable), the corresponding credit is not debited or is credited back.
- Account deletion: unused credits are lost with the account.
- Refund by a store: if Apple or Google refunds a credit purchase, the corresponding credits are removed from your account, up to the remaining balance.
8. Right of withdrawal
You normally have 14 days to withdraw, without giving a reason, from the conclusion of the contract. However, under article L221-28 13° of the French Consumer Code, you can no longer exercise this right for digital content not supplied on a tangible medium whose performance has begun with your prior express consent and after you expressly waived your right of withdrawal.
When you pay on the website, we ask for this consent and waiver at the time of payment (a message displayed next to the “Pay” button): by paying, you request immediate access and acknowledge that you lose your right of withdrawal as soon as performance begins (credits added, content unlocked, Premium access activated).
Subscription: if, despite the above, your right of withdrawal applies (for example if you did not request immediate performance), you can exercise it within 14 days; you then pay only for the service supplied until your request, pro rata, and the rest is refunded within 14 days by the same means of payment.
How to withdraw: by an unambiguous statement sent to [email protected] (you may use the template below). For a purchase through the App Store or Google Play, the request is made to the store (Apple: reportaproblem.apple.com; Google: Google Play order history), which applies its own refund rules.
Withdrawal form template (optional) — To Jean Paul BELLA, 195 rue de la Montagne, 57200 Sarreguemines, France, [email protected]: I hereby give notice that I withdraw from my contract for the supply of the digital content/service below: ordered on …; name of consumer: …; address of consumer: …; date: …
9. Statutory guarantees
The Seller is bound by the statutory guarantee of conformity applicable to digital content and services (articles L224-25-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). If the content or service does not conform, you can obtain conformity or, failing that, a price reduction or termination of the contract. These guarantees apply free of charge and independently of any other guarantee.
10. Liability
Products are supplied for personal use. AI-generated analyses are estimates and are not medical advice (see the terms of use). Nothing limits a consumer's statutory rights.
11. Complaints
For any complaint: [email protected] or the contact form. We acknowledge receipt and reply as soon as possible.
12. Personal data
Data needed for the sale is processed in accordance with the privacy policy. Accounting records are kept for 10 years.
13. Governing law and changes
These terms are governed by French law; a consumer keeps the mandatory protection of the country where they live. We may change them: the version applicable to an order is the one in force when it was placed; for a subscription, any change is notified before it applies at the next renewal.
